Sexual Harassment Prevention and Resolution Policy

 

 

1. Introduction

 

The Rosalind Franklin University of Medicine and Science/The Chicago Medical School is committed to providing its staff, faculty and students the opportunity to pursue excellence in their academic and professional endeavors. As stated in the Employee Handbook of the University, our employees, faculty, and students have a right to work in an environment free from harassment of any kind. Any supervisor, other employee, third party, or student, who uses implicit or explicit sexual requests or demands for sexual behavior to control, influence, or affect the career, salary, job or working environment of an employee, or the educational climate or advancement of a student, is engaging in sexual harassment.

 

Sexual harassment, whether between people of different sexes or the same sex, is defined by the Equal Employment Opportunity Commission to include, but is not limited to, unwelcome sexual advances, requests for sexual favors, and other behavior of a sexual nature when:

 

A. Submission to such conduct is made implicitly or explicitly a term or condition of an individual's employment or participation in an educational program,

 

B. Submission to or rejection of such conduct by an individual is used as the basis for personnel decisions or for academic evaluation or advancement,

 

C. Such conduct has the purpose or effect of unreasonably interfering with an individual's work or academic performance or creates an intimidating, hostile or offensive working or educational environment.

 

Fundamental to the University's purpose is the free and open exchange of ideas. It is not, therefore, the University's purpose in promulgating this policy to inhibit free speech or the free communication of ideas by members of this academic community.

 

 

2. Policy

 

The University will not tolerate sexual harassment. It is a form of discrimination, a violation of federal and state law, and a serious violation of University policy. In accordance with its educational mission, the University works to educate its community regarding sexual harassment.

 

To enable the University to maintain an atmosphere free of sexual harassment, individuals who either believe they have experienced sexual harassment, or may have witnessed sexual harassment, are provided formal and informal avenues to present their complaints or concerns. Complainants are assured that problems of this nature will be treated in a manner supportive of their privacy, subject to the University's legal obligation to respond appropriately to any and all allegations of sexual harassment.

 

The University prohibits acts of reprisal against anyone involved in lodging a complaint of sexual harassment or serving as a witness in an investigation into a sexual harassment complaint. This policy of no tolerance to reprisal also applies during the course of an investigation. Conversely, the University considers filing intentionally false reports of sexual harassment a violation of this policy. The University will promptly respond to all complaints of sexual harassment. If an investigation results in a finding that an individual has violated this policy, the University may institute disciplinary proceedings against the offending individual, which may result in a range of sanctions, up to and including termination of University affiliation. The University will take corrective measures including reasonable remediation of the effects of the harassment on the complainant and others, if appropriate.
